Terms of service


GENERAL

These terms and conditions apply when Keepr ApS ("KEEPR") facilitates the sale of circulated designer furniture and interiors (“Products”) between companies (“Sellers”) and users (“Buyers") on keeprcollective.com ("the Service").

KEEPR is owned and operated by Keepr ApS, CVR no. 42604968, Ryesgade 19A, 2200 Copenhagen N, e-mail: info@keeprcollective.com.

Keeprcollective.com is offered and managed as a marketplace on behalf of a number of independent Sellers who market and sell their Products via the Service. KEEPR acts only as an intermediary, not as a Seller, and at no point holds ownership of the Products facilitated via the Service. Any purchase made on keeprcollective.com is thus a purchase agreement between the Buyer and the Seller offering the given Product. The Seller's name must always be visible to the Buyer in the product description and order confirmation.

The Danish Consumer Contracts Act applies to the purchase of Products via the Service in cases where the Buyer is a private individual, but not in cases where the Buyer acts in the capacity of a business.

We reserve the right for sold-out items, typing errors, price changes, and technical errors. If an item a Buyer has ordered proves to be sold out, we will contact the Buyer as soon as possible. In such cases, we reserve the right to cancel the order in full or in part. The Buyer will receive a full refund if the payment has already been processed.

These terms and conditions, as well as any other terms and conditions published on keeprcollective.com, apply to the use of the Service. KEEPR may unilaterally change these terms. By using the Service, the Buyer accepts these Terms in their entirety and undertakes to comply with them.


PRICES, PAYMENT AND VAT

Product prices and shipping costs are stated in the product description and at checkout on keeprcollective.com. Prices may change from time to time. 

KEEPR receives payments through a secure and PCI-compliant payment service provided by a third party. We accept payment by credit card (including Dankort, VISA/Dankort, VISA, VISA Electron, and Mastercard), MobilePay, PayPal, and Klarna.

Payment will be charged in Danish Kroner (DKK) and deducted from the Buyer's account when the order has been dispatched. 

Products are sold on the Service according to Danish VAT rules. KEEPR sends a payment confirmation to the Buyer, containing information about VAT, on behalf of the Seller. If the Buyer is a VAT-registered company, the Buyer may be entitled to a VAT deduction according to general Danish VAT rules.


DELIVERY

KEEPR currently ships to Denmark, Germany, Sweden, Finland, Netherlands and Belgium.

Delivery options and shipping costs may vary depending on the Product and delivery address. All delivery options available for a given Product are shown at checkout.

Once an order is completed, the Buyer receives an e-mail from KEEPR with all details of the purchase. Orders are typically dispatched within 1-7 business days, after which the Buyer receives an e-mail with tracking information. The Buyer is advised that the shipping times shown at checkout are indicative. If delays occur with the courier used, this will correspondingly delay the delivery relative to the stated delivery date.

If a Buyer places an order with Products from different Sellers, KEEPR reserves the right to deliver the Products separately.


RIGHT OF WITHDRAWAL

Purchases on keeprcollective.com are covered by Section 18(1) of the Danish Consumer Contracts Act, which means that private Buyers have a 14-day right of withdrawal from the day the Product is received. KEEPR does not accept returns of Products that have been used by the Buyer. The right of withdrawal also does not apply if the Buyer acts as a business trader.

If you wish to exercise your right of withdrawal, you must inform us within 14 days of receiving the Product. When exercising the right of withdrawal, the Buyer must return the Product at their own expense within 14 days after informing us of the withdrawal. 

Notification of withdrawal must be sent to info@keeprcollective.com and include the order number, date of purchase, as well as name and email address. Once we have received your inquiry regarding the withdrawal of your order, we will create and send a return label to you, the cost of which will be deducted from your refund. We always provide the price of return shipping before sending you the return label. 

Return shipments are the Buyer's responsibility, and the Buyer thus bears the risk of loss and damage until the Product is received by KEEPR. The Buyer must handle and pack the product securely to avoid damage during return. The Buyer is recommended to save the receipt proving that a Product has been handed over to a courier for return shipping.

Refunds are made within 14 days to the same payment card used for the purchase. Please note that any shipping costs are not refunded. 


WARRANTY AND CLAIMS

At KEEPR, the Buyer has a 2-year right to claim for defects. Any faults or defects in a Product purchased on keeprcollective.com must be claimed by contacting KEEPR at info@keeprcollective.com. 

The Buyer should be aware that the Product's actual appearance may differ from what appears in the images. Products are sold as described in the product description at the time of purchase. The description must contain all relevant information about the Product's condition and any damage, defects, or irregularities that the Seller is expected to know about at the time of purchase. As long as any defects are disclosed in writing in the product description, the Seller is not responsible for replacing Products with such defects.

Failure to provide essential information is considered a defect in the Product. If the Seller is responsible for a Product that is defective, the Buyer will be entitled to have the purchase canceled or receive a proportionate reduction in price. If the purchase is canceled, the Buyer will be entitled to a refund of the sales price, but not delivery costs, upon returning the Product.

If a package is significantly damaged at the time of delivery, the buyer is encouraged to refuse to receive the package from the courier.


LAW AND COMPLAINTS PROCESS

Terms and agreements created through the Service are subject to Danish law. Any disputes regarding the terms or purchase agreements created via the Service are subject to Danish law and shall be settled at the Copenhagen City Court, unless otherwise provided by applicable law.

If you wish to complain about a purchase, please contact info@keeprcollective.com. If a solution cannot be reached, you can submit a complaint to the relevant boards in the field, provided the conditions are met. A complaint can be submitted to the Center for Complaint Resolution under the Consumer Complaints Board, via the Complaint Portal for Nævnenes Hus (see more here).

If you are a consumer residing in an EU country other than Denmark, you can complain to the EU Commission's online complaint portal here http://ec.europa.eu/odr


FORCE MAJEURE

In the event of force majeure events that prevent or delay KEEPR or the Seller from fulfilling their obligations under these terms, KEEPR and the Seller are exempt from liability and other sanctions, provided that KEEPR informs the Buyer of these circumstances within a reasonable time. For example, natural disasters, fire, new or changed legislation, war, and similar events are considered factors beyond the control of KEEPR and the Seller. 

ACCESS TO THE SERVICE

KEEPR does not guarantee uninterrupted availability of the Service. KEEPR is not liable for any loss that may occur if a user cannot access the Service due to a technical problem, unless otherwise provided by applicable law. KEEPR reserves the right to update, renew, or discontinue the provision of the Service or parts thereof.

When users shop on keeprcollective.com, Keepr ApS and the relevant Sellers collect and process personal information within the framework of applicable data protection legislation and in accordance with KEEPR's privacy policy (read more here).
